Thank you for trusting Sabio Newton.
Every Drainage Calculation Certificate starts with information — from the providers who use the app and, often, about the homeowners they serve. We treat that information with the same care we put into the proven math: we use it only for the purposes described here, we never sell it for money, and we explain plainly where it goes.
This policy tells you what we collect, why, and the choices you have. If you have a question, write to us at [email protected]. We're glad to help.
1. Purpose and Scope.
This Privacy Policy ("Policy") explains how Daedelix Inc. ("Sabio Newton," "Company," "we," "us," or "our") collects, uses, shares, and protects personal information through:
- Our websites at https://sabionewton.com and https://app.sabionewton.com, and any related subpages, including the Certificate Verification page (together, the "Website").
- The Sabio Newton mobile application for iPhone and Android (the "App").
- Our email communications and trade show and event sign-ups.
Together, these are the "Service."
This Policy applies to three groups of people:
- Providers — landscapers, contractors, plumbers, and other home service professionals who create an account and use the App.
- Property owners — homeowners and others whose property is the subject of a Drainage Calculation Certificate. Property owners do not use the App, but a Provider may enter information about their property, and they may use the Certificate Verification page.
- Website visitors — anyone who browses the Website, reads our content, or joins our email list.
This Policy does not cover information collected by third-party websites or platforms, including the Apple App Store and Google Play, which have their own privacy policies.
This Policy describes our data practices. Where required by applicable law, we will obtain your consent before collecting or processing your personal information. By providing your information through forms, account registration, or purchases, you consent to the practices described in this Policy. For browsing data and cookies, see Section 8.
2. Age Requirements.
The Service is a professional tool intended for adults. We do not knowingly collect personal information from anyone under the age of 18, and the App is available only to users 18 and older. If we learn that we have collected personal information from someone under 18, we will promptly delete it. If you believe we have collected such information, please contact us at [email protected].
3. Legal Bases for Processing.
We process personal information only when we have a valid legal basis to do so. Depending on the circumstances, we rely on one or more of the following:
- Contract Performance. Processing necessary to provide the App to Providers under our Terms of Service, including running Calculations and issuing Certificates.
- Legitimate Interests. Processing necessary for our legitimate business interests, such as operating Certificate Verification so Certificates can be confirmed as authentic, preventing fraud and misuse of Certificates, securing the Service, and improving our products, provided those interests are not overridden by your rights.
- Consent. Where you have given clear consent, such as subscribing to marketing emails or allowing optional cookies. You may withdraw consent at any time.
- Legal Obligation. Processing necessary to comply with applicable laws, regulations, or legal processes.
4. Information We Collect.
From Providers (App users):
- Account and Business Information. Name, business name, email address, company logo, and password or sign-in credentials. Passwords are stored only in hashed form. You may also add a profile photo. Your language setting is stored on your device and is not collected by us.
- Crew Invitations. When you invite a crew member to your company workspace, you provide the invitee's email address, optionally the invitee's name, and the role assigned. We use the email address only to send the invitation, and the invitee sets their own password upon acceptance.
- Subscription Information. Subscription status, plan, renewal dates, certificate pack purchases, and transaction identifiers we receive from the Apple App Store or Google Play through our in-app purchase provider, RevenueCat. We do not receive or store your full payment card number.
- Project and Calculation Information. Site Inputs you enter for a job, including ZIP code, watershed (drainage) area, run length, and slope; the job site address; the name of the customer the Certificate is issued for (ordinarily the property owner); an optional area nickname (such as "backyard"); the contractor name shown on the Certificate, if different from the company name; the rainfall data retrieved; the recommended pipe size; and the date and time of each Calculation.
- Photos. Your company logo; as-built photos that you attach to a job or a Certificate; and any photos you choose to send to Ask Sabio, our AI assistant, such as a photo of the yard when you ask a sizing question, or a photo of the ground for soil classification. The App asks for camera and photo library access only when you add one of these photos. We do not collect video.
- Certificate Records. The contents of each Drainage Calculation Certificate you issue, its unique Certificate ID, and its issue date.
- Ask Sabio Information. The questions you ask Ask Sabio and the responses it provides.
- Voice Mode and Read-Aloud (optional). Voice mode is optional. When you start a voice conversation with Ask Sabio, your microphone audio is streamed to our service provider OpenAI to process the live conversation. We do not store the audio. The App uses the microphone only for voice mode, and only while a voice conversation you started is open. A text transcript of the voice conversation is saved to your Ask history and is visible only to you. Deleting your account in the App deletes your Ask history, including these transcripts, and you may ask us to delete a transcript at any time by emailing [email protected]. When you use read-aloud, the text of an answer or guide is sent to our service provider ElevenLabs to generate speech. No audio of you is sent. Generated audio clips may be cached on our servers for replay.
- Support and Feedback. Messages you send us, beta testing feedback, survey responses, and any screenshots or recordings you choose to share.
About property owners (provided by Providers):
- Information a Provider enters about a job, which may include the property's ZIP code, the job site address, the customer's name, and an optional area nickname (such as "backyard"), along with the Site Inputs, Calculation results, and any as-built photos.
From Certificate Verification users:
- The Certificate ID entered, the date and time of the lookup, and technical information such as IP address and browser type.
From website visitors and email subscribers:
- Name, email address, trade or role (for example, contractor or homeowner), preferred language, and any message you send us by email or through a form on the Website.
- Contact information you give us at trade shows and events, such as by scanning a QR code or completing a sign-up form at our booth.
Collected automatically from all users:
- Device and Usage Information. Our analytics and advertising tools on the Website collect device type, operating system, browser type, IP address, pages viewed, features used, and referring websites.
- Crash and Error Reports (App). When the App crashes or a required step fails, the App sends a report to our own servers. No third-party crash reporting service is used. A report contains the error message and technical trace, App version and build, platform and operating system version, App language, the screens opened immediately before the error, and a random identifier created at installation. That identifier is not your device identifier and is not linked to your account. Email addresses, sign-in tokens, and similar details are removed before the report leaves your device and again when we receive it. Your IP address is used only to limit how many reports can arrive from one place and is not stored. Reports are kept for up to 90 days.
- Approximate Location. Our analytics and advertising tools on the Website may infer your general location, such as your city or region, from your IP address. The App does not use your device's location and does not request location permission. The only location information you provide is the ZIP code you type in. The App converts that ZIP code to approximate coordinates on your device and sends only those coordinates to the National Weather Service (NOAA) to retrieve rainfall data.
We do not intentionally collect Social Security numbers, financial account numbers, health information, or other sensitive personal information about property owners, and our Terms of Service prohibit Providers from entering it.
5. Sensitive Personal Information.
Some of the information we collect may be classified as "sensitive personal information" under applicable privacy laws, including account login credentials (a username combined with a password). We use sensitive personal information only as necessary to provide the Service you request, keep your account secure, and comply with legal obligations. We do not use or disclose sensitive personal information for any other purpose.
6. Sources of Information.
- Directly from You. When you create an account, use the App, contact us, or sign up at an event.
- From Providers. Property owner information is entered by the Provider who performs the Calculation.
- From Workspace Owners. When a workspace owner invites a crew member to their company account, the owner provides that person's contact information, such as their email address. The invited person sees this Policy and accepts our Terms of Service when they create their own account.
- From App Stores. Apple and Google provide us with subscription and transaction status.
- From Public Data Sources. Rainfall data from the National Oceanic and Atmospheric Administration ("NOAA"). NOAA data does not contain personal information.
- From Analytics and Advertising Providers. Such as Google Analytics, Google Ads, and Meta, which tell us how people find and use the Website.
- Automated Data Collection. Cookies, pixels, and similar technologies on the Website. See Section 8.
7. How We Use Your Information.
- To provide the App. To create and manage accounts, run Calculations, issue Certificates with the Provider's business name and logo, and provide customer support.
- To operate Certificate Verification. To let anyone holding a Certificate ID confirm that a Certificate is authentic and that its contents match our records.
- To manage subscriptions. To confirm subscription status with the App Stores and apply the monthly Certificate allowance.
- To prevent misuse. To detect forged or altered Certificates, unauthorized account sharing, prohibited marketing claims about Certificates, and other violations of our Terms of Service.
- To communicate with you. To send account notices, service updates, and responses to your questions, in English or Spanish based on your preference.
- To market the Service. To send newsletters, launch announcements, and offers to people who have opted in, and to follow up with contacts from trade shows and events. You can unsubscribe at any time.
- To improve and develop the Service. To analyze usage, fix bugs, improve the calculator and the App, and develop new features, including using de-identified and aggregated Calculation data.
- To provide Ask Sabio. To generate responses to your questions, including any photos you choose to send for soil classification, and to run voice conversations and read answers aloud.
- To comply with legal obligations and protect our rights. To respond to lawful requests, enforce our Terms of Service, and protect the rights, safety, and property of the Company, our users, and others.
8. Cookies, SDKs, and Tracking Technologies.
We use cookies, pixels, web beacons, and similar tracking technologies on the Website in the following categories:
- Strictly Necessary. Required for the Website and App to function and stay secure (for example, keeping you signed in). These cannot be disabled.
- Performance and Analytics. Help us understand how visitors interact with the Website, such as Google Analytics.
- Functional. Remember your preferences, such as your language.
- Advertising. Allow us and advertising partners such as Google Ads and Meta to measure and deliver relevant ads, including on other websites and platforms.
The App does not incorporate analytics, advertising, or crash-reporting software development kits ("SDKs"). The App contains no advertising and no third-party tracking, does not request or use your device location, and does not track you across other apps or websites. Before incorporating any such SDKs into the App, we will update this Policy and obtain any consent required by applicable law, including through Apple's App Tracking Transparency framework on iOS devices.
You can manage cookie preferences through our cookie consent tool on the Website or through your browser settings, and you can limit ad tracking in your device settings. For opting out of the sale or sharing of personal information, see Section 10.
9. How We Share Information.
We share personal information only as described below.
- Certificate Verification (public). When a Provider issues a Certificate, anyone who has its Certificate ID can view the following on the Certificate Verification page: the Provider's company name and logo; the date the Certificate was issued; whether the Certificate is valid or has been revoked; the sizing summary (pipe diameter, slope, and required flow rate); the design calculation checks and whether they passed; the attestations the Provider signed about the installed work; and the number of as-built photos attached. The Verification page does not display the job site address, the area nickname, the contractor name, any photos, or the name or email address of any individual. The Certificate itself displays the job site address, the customer's name, the area nickname, the Provider's company name and logo, and any contractor name entered, and may be shared by the Provider or property owner with anyone. Providers and property owners should treat Certificate IDs like a reference number and share them only with people they want to be able to view the Certificate.
- With the Provider's customers. Certificates are delivered by the Provider to their customer. What the Provider does with a Certificate after that is up to the Provider.
- Service Providers. Companies that help us operate the Service under contracts that limit their use of personal information, including:
- Hosting, Database, and App Infrastructure. Amazon Web Services (United States), which hosts the App and stores your logo and any photos you upload, and the crash and error reports the App sends to our servers.
- Website and CRM Platform. GoHighLevel, which hosts our marketing website at sabionewton.com and any forms and email lists we use for marketing.
- Email and Messaging. Amazon SES, to send account emails from the App. Any marketing emails are sent through GoHighLevel.
- Analytics. Google Analytics, on our marketing website.
- Marketing Agency. Dirty Marketing Group, Inc., which manages our marketing website, analytics, and advertising on our behalf.
- Artificial Intelligence Providers. Anthropic, or depending on configuration OpenAI or Google, which receive your Ask Sabio questions and any photos you attach in order to generate responses. When Ask Sabio needs to look something up, only the search text is sent to Brave Search or DuckDuckGo, never your photos.
- Voice Conversations. OpenAI, which receives your microphone audio and the text of the conversation only while a voice conversation with Ask Sabio is open. We do not store the audio.
- Text to Speech. ElevenLabs, which receives the text of an answer or guide when you use read-aloud. No audio of you is sent.
- In-App Purchases. RevenueCat, which receives your organization ID and your App Store and Google Play purchase history so we can unlock what was paid for.
- Weather Data. The National Weather Service of the National Oceanic and Atmospheric Administration (NOAA), which receives only the approximate coordinates derived from the ZIP code you enter, to return rainfall data. Nothing that identifies you or your company is sent.
- App Stores. Apple and Google, to process subscriptions and payments under their own privacy policies.
- Advertising Networks. Meta, Google, and similar platforms, on the Website only, as described in Section 8.
- Legal Authorities. When required by law, subpoena, or court order, or to protect our legal rights, safety, or property, or those of our users or others.
- Corporate Transactions. In connection with a merger, acquisition, financing, or sale of assets. We will notify you of any significant change in how your information is handled.
- De-identified and Aggregated Information. Information that cannot reasonably be used to identify you, a property owner, or a specific property, for analysis, research, and product development.
- With Your Consent. In any other situation, only with your consent.
We do not sell personal information for money. We do not maintain or publish a directory or list of Providers.
10. Sale and Sharing of Personal Information.
We do not sell your personal information for direct financial compensation. However, we may allow certain advertising partners to collect information about your activity on our Website through cookies or pixels. Under certain privacy laws, including the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA"), this may be considered a "sale" or "sharing" of personal information for cross-context behavioral advertising.
You may opt out of the sale and sharing of your personal information by:
- Clicking the "Do Not Sell or Share My Personal Information" link on our Website.
- Enabling a Global Privacy Control (GPC) signal in your browser. We honor GPC signals as a valid opt-out request.
- Adjusting your cookie preferences through our cookie consent tool or your browser settings, or limiting ad tracking in your device settings.
- Opting out of marketing emails through the unsubscribe link in any email.
- Contacting us at [email protected].
11. Your Privacy Rights.
You have certain rights regarding your personal information under applicable privacy laws. The specific rights available to you depend on where you live.
- Right to Access and Know. Request access to the personal information we hold about you, including the categories and sources of information, why we collect it, and the categories of third parties we share it with.
- Right to Correction. Request correction of inaccurate personal information. Because a Certificate documents a Calculation as it was run, we correct errors by noting the correction on our records rather than changing the Site Inputs on an issued Certificate.
- Right to Deletion. Request deletion of your personal information, subject to legal exceptions. Providers can delete their account in the App (Profile → Delete account) or by emailing [email protected] from the email address on the account. Step-by-step instructions are at https://sabionewton.com/delete-account. We complete email requests within 30 days. Account deletion removes your name and email address, ends your sign-in sessions, and revokes your access to your organization's records. When you delete your account in the App, we also delete your Ask history (including voice transcripts), your profile details and photo, and the devices and notifications associated with your account. Deleting your account does not cancel an App Store or Google Play subscription.
- Right to Opt Out. Opt out of marketing emails, and of the sale or sharing of personal information or targeted advertising (see Section 10).
- Right to Data Portability. Request a copy of your information in a commonly used format.
- Right to Limit Use of Sensitive Personal Information (California residents).
- Right to Non-Discrimination. We will not discriminate against you for exercising your privacy rights.
- Right to Appeal. If we decline your request, you may appeal by emailing [email protected] with the subject line "Privacy Rights Appeal." If your appeal is denied, you may contact your state attorney general.
Certificate records and deletion. Issued Certificates are business records that property owners, inspectors, and others may rely on through Certificate Verification. If a Provider deletes their account, we delete the Provider's account profile and contact information but keep the Certificate records needed for verification permanently, as described in Section 13, unless the law requires otherwise. If you are a property owner and want your information removed from a Certificate record, contact us and we will work with you and the Provider who issued it.
How to exercise your rights. Contact us using the methods in Section 16. We will respond to verifiable requests within the time required by law (generally 45 days under the CCPA/CPRA). We may need to verify your identity before acting on a request, and we may require proof of authorization if an authorized agent submits a request for you.
12. Do Not Track and Global Privacy Control.
Our Website honors Global Privacy Control (GPC) signals as a valid opt-out request for the sale and sharing of personal information associated with that browser. There is currently no industry standard for responding to Do Not Track (DNT) signals. We will update this Policy if one is adopted. For more about GPC, visit https://globalprivacycontrol.org.
13. Data Retention.
We keep personal information only as long as needed for the purposes described in this Policy:
- Provider account information: for as long as the account is active, plus seven (7) years for tax, accounting, and legal purposes.
- Certificate records: permanently; issued Certificates are not deleted, so that Certificates remain verifiable, even if the Provider's account is closed.
- Calculations that did not result in a Certificate: kept as job records. Job records and photos are retained after a user's access is revoked; closing an account ends access to them but does not erase them.
- Ask Sabio conversations, including voice transcripts: until you delete your account in the App or ask us to delete them. Voice audio is not stored.
- Crash and error reports: up to 90 days.
- Marketing data: until you unsubscribe or ask us to delete it.
- Analytics and log data (Website): up to 14 months.
- Legal and compliance records: as required by law.
After the applicable period, we securely delete or de-identify personal information. When a stored file is deleted, a previous copy may remain in backup storage for up to 90 days before it is permanently removed.
14. Data Security.
We use reasonable technical and organizational measures to protect personal information, including encryption in transit, access controls, and secure data storage. All data the App sends to our servers travels over HTTPS, with no unencrypted fallback. Photos are encrypted at rest in private storage and are reachable only through short-lived signed links, never a public URL. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials secure.
15. Changes to This Policy.
We may update this Policy from time to time. The "Last Updated" date at the top shows the current version. If we make material changes, we will notify you by email, in the App, or by posting a notice on our Website. Your continued use of the Service after changes take effect means you accept the updated Policy.
This Policy is available in English and Spanish. If there is any conflict between the two versions, the English version controls.
16. Contact Us.
